Terms of Use for Emotes

By purchasing or downloading emotes from Otter Mage Designs, Bento Studios, or Jade (“website”) or as a reward from our Patreon community ("Patreon"), you agree to the following Terms of Use. These terms are legally binding and govern the rights and limitations associated with the use of our emotes.

1. Emote Acquisition

Where Emotes Are Available:

  • Website Shop: Purchased emotes are delivered via a downloadable ZIP file through the website.

  • Patreon: Monthly emote downloads are available for 30 days as part of Patreon rewards.

Included in the Download (ZIP File):

  • A link to this Terms of Use page.

  • Three PNG versions of the emote (28px, 56px, 112px).

  • A limited, non-exclusive, non-transferable license to use the emotes (unaltered) on Discord, Twitch, and YouTube for professional, personal, or community purposes. Not for resale.

Emote Compliance:

  • Emotes are formatted to meet Discord, Twitch, and YouTube upload requirements. However, users must verify compliance with specific platform policies. If an issue arises, users may notify us by completing the contact form on the website, but we are not responsible for platform policy changes.

2. Restrictions on Use

The following actions are strictly prohibited:

  1. Redistribution: Emotes may not be uploaded to databases, repositories, or third-party marketplaces for free or paid distribution.

  2. Modification: Users may not remove, edit, or obscure any artist signatures.

  3. Misrepresentation: Users may not claim ownership, resell, or offer emotes as commissions, giveaways, or prizes.

  4. AI Usage: Emotes may not be used with generative AI models or image-training tools.

  5. Future Updates: Purchases do not include updates or future versions of an emote. Users must purchase updated versions separately.

  6. Lost Files: Users are responsible for securely storing their purchased emotes. Lost emotes will not be replaced.

  7. Availability & Pricing: Emote sets may be discontinued, and prices are subject to change without notice. No price matching is offered.

  8. Delivery Issues: Emote delivery is near-instant. Users must report missing or defective files within 7 business days. We will make reasonable effort to respond within 5 business days. Business days are counted as Monday through Friday. Saturdays and Sundays are excluded. National holidays for US and Japan are observed and are, therefore, excluded from “business days”. Failure to report within 7 days forfeits any claim for redelivery.

  9. Platform Compliance: Users are solely responsible for ensuring that emotes comply with the Terms of Service of Twitch, YouTube, Discord, or any other platform where they are uploaded.

  10. High-Resolution Files: The 300 DPI high-resolution version of an emote is not included. If a larger version is required, users may contact us by completing the contact form on this website for a custom purchase at a premium rate.

  11. Fan Art Disclaimer: Any fan art-based emotes are used at the user’s own risk.

3. Recommended Attribution (Optional, but Encouraged)

Users are encouraged to credit the Twitch account JadeTheOtterMage within Twitch’s emote settings.

4. Reporting Issues & Contact Information

  • Users must report issues via the official Contact Form on our website.

  • Do not contact us via social media, Discord, or email.

  • Custom emote or graphic requests will not be accepted.

5. Patreon Involvement

  • Patreon supporters at certain tiers may vote on the emote design for each month.

  • Emotes are uploaded before the end of the month.

  • Patreon rewards may include emotes that are unavailable in the shop at the time of the perk.

  • There is no guarantee that a Patreon reward emote will be made available in the shop.

  • All the above and below sections and terms apply to emotes downloaded on any Otter Mage Designs or Bento Studios Patreons created by and operated by Jade.

6. Final Acknowledgment

By purchasing or downloading an emote either on this site, through Patreon, or another official source of Otter Mage Designs and Bento Studios emotes, you acknowledge that you have read, understood, and agreed to these Terms of Use. Violation of these terms may result in the revocation of your license to use the emotes without a refund and potential legal action..
